Terms of Use

1) The Service consists of a data and SMS only service (i.e. no voice connectivity) provided to you. If you have not expressly indicated your acceptance of these terms of use, your use of the Service may be taken by Truphone as acceptance.

2) Truphone does not warrant or guarantee a fault free Service and give no warranties or guarantees as to network coverage, quality or availability. In the event of a fault, upon becoming aware of the fault or upon receipt of notice of the existence of such a fault by you, we shall use reasonable efforts to promptly correct the fault.

3) We reserve the right to suspend the Services without giving you notice where we reasonably believe that suspension is necessary for any commercial reason or if we believe the Service is being used for an inappropriate purpose – which we may determine in our reasonable discretion.

4) All warranties, conditions and other terms implied by statute or common law are to the fullest extent permitted by law excluded from the Agreement.

5) Subject to liabilities which, by law may not be excluded, in no event shall Truphone be liable to you whether in contract, tort (including for negligence or breach of statutory duty) or otherwise, arising out of or in connection with the performance of the Agreement, for any direct, indirect or consequential losses, including but not limited to, any loss of profit, revenue, contracts, data, goodwill or other similar losses or for any loss or corruption of data or information or any special or pure economic loss, costs, damages, charges or expenses.
