Fair Usage Policy
To ensure all our customers can enjoy the best possible Truphone experience, the usage of the Truphone Service is subject to our fair usage and acceptable usage policies. In essence, the usage of the Truphone Services is solely permitted for reasonable use with a mobile device.
The details of our fair usage policy are stated below:
1. Use for commercial gain is forbidden:
1.1 Without Truphone's express written agreement Customer must not engage in re-selling or rebilling of the Truphone Services or any part of them (e.g. voice or data); and
1.2 Except to the limited extent permitted under the applicable purchased plan, Customer is only permitted to use the Truphone Services strictly for personal or legitimate day-to-day business use only.
2. Fair use details:
2.1 Customers must not use the Truphone data service for any of the following:
a) machine-to-machine applications (unless otherwise agreed in writing by Truphone);
b) excessive downloading, uploading and / or streaming of content and /or data, for example by using video conference facilities or sending and /or receiving excessively large files; and /or
c) in ways that may adversely impact on other Truphone customers or the Truphone network.
2.2 Your permitted data usage is for web browsing, messaging, and similar activities on your device. With the exception of tethering for your sole business use, you are not permitted to use your SIM card to access data on any other equipment.
2.3 For billing purposes each SIM Card will have a designated primary country within the Truphone Zone* (each a "Home Country"). Each End User must remain domiciled in the Truphone Zone during the period of provision of the Services. . If an End User becomes domiciled outside the Truphone Zone during the Contract Period, Truphone reserves the right to immediately suspend and / or terminate the End User's use of the SIM Card.
2.4 The SIM Card must register on the correct Home Country's network on first use. If the SIM Card registers or attempts to register in any country which is not its designated Home Country, Truphone reserves the right to suspend Service access to the SIM Card.
2.5 In addition to the periodic volume reviews stated in 2.6 below, Truphone reserves the right to suspend Service(s) access to any SIM Card which is used predominantly outside the Truphone Zone for thirty (30) or more consecutive days within the Contract Period.
2.6 All data usage is subject to periodic volume reviews and Truphone reserves the right to limit or regulate the volume of data usage where there is evidence of continuing excessive data usage. Truphone's actions in this regard may include taking measures such as temporarily reducing data throughput for a subset of customers who use a disproportionate amount of bandwidth. We may also suspend, terminate, or restrict your data session, service plan, or service if you use your data usage in a manner that interferes with our other customers' service, our ability to allocate network capacity among customers, or that otherwise may degrade service quality for other customers.
2.7 If Truphone has reason to believe that any of this policy is not being observed Truphone reserves the right to :
a) apply additional charges;
b) regulate speed of Service; and / or
c) terminate access to the Service.
*Currently the Truphone Zone comprises Australia, Germany, Hong Kong, Poland, Spain, The Netherlands, United Kingdom and United States. This is subject to change.
